Terms of Service

The agreement between you and VCorps for using Biloou. Written to be read, not to be skipped.

The agreement

These terms are between you and VCorps (“we”, “us”), who operate Biloou at https://designs.biloou.com and the portfolio addresses under biloou.com (the “service”).

By creating an account or using the service you accept them. If you do not, do not create an account. You must be old enough to enter into a contract where you live; if you are under 18, use the service only with a parent or guardian’s agreement.

The Privacy Policy forms part of these terms and explains what we do with your information.

Your account

Accounts are created and entered through Google. We never see, ask for or store a password, because the service does not have any.

  • One account, one portfolio. Do not create several accounts to get around that.
  • Your Google account is the key. Keep it secure. Anyone who can sign in to it can sign in here, and we have no other way to tell you apart from them.
  • The email address must be one you control and Google must have verified it. We check that on every sign-in.
  • Losing the Google account means losing this one. There is no password fallback, no recovery question and no reset email. This is the trade for never storing a password, and it is worth knowing before you rely on the service.

What you may and may not do

Use the service to build and publish a portfolio of your own work. Do not use it to:

  • publish anything unlawful, or anything that infringes somebody else’s copyright, trademark, privacy or other rights;
  • impersonate another person, or present someone else’s work as your own;
  • publish material that harasses, threatens or defames anybody, or that is sexually explicit;
  • publish malware, phishing pages, or links whose purpose is to deceive;
  • send unsolicited bulk messages, or use a published page as a redirect for one;
  • attack, probe, overload or attempt to gain unauthorised access to the service or to anybody’s account;
  • scrape the service at a scale that degrades it for other people, or automate account creation.

If you are an administrator of this installation, the template upload facility runs uploaded PHP as part of the application. Treat that permission as equivalent to filesystem access and give it out accordingly.

Your content, and who owns it

Your work stays yours. Everything you write, upload or arrange your text, your pictures, your layout remains yours. We claim no ownership of it.

You give us only the permission needed to run the service: to store your content, to process it, and once you publish to serve it publicly at your portfolio address. That permission exists so the software can do the thing you asked it to do, and it ends when the content is deleted.

You confirm that you have the right to publish what you upload. If a picture, a logo or a piece of writing is not yours, do not put it up.

The service itself the software, the templates that ship with it, the name and the design remains ours or our licensors’.

Publishing

A portfolio is private until you publish it. When you do, it becomes public to anyone with the address, and it can be indexed by search engines, cached, archived and quoted by third parties we do not control. Publish accordingly: personal details on a published page are published details.

Unpublishing removes it from the service immediately, but it cannot reach into a search engine's cache or somebody's copy of it. Nothing we do can make a page that has been public stop having been public.

Portfolio addresses are assigned as they are asked for. We may reclaim one that impersonates somebody, infringes a trademark, or is reserved for the service’s own use.

Importing from a CV

The optional CV import sends the text of the file you upload to OpenAI so that it can be sorted into fields. That includes any personal detail printed on it. Using the feature is your decision, taken once per import, and the dashboard says so on the page before you upload anything.

Do not upload a CV containing somebody else’s personal information unless you have their agreement. The result is a draft: check it, because an automated reading of a document can be wrong, and nothing is published until you publish it.

Availability, and what we do not promise

The service is provided as is and as available. We do not promise it will be uninterrupted, error-free, or that it will keep working with any particular browser or device. We may change, suspend or withdraw features, and we may take the service down for maintenance.

Keep your own copy of anything you would mind losing. We take reasonable care, but the service is not a backup service and should not be the only place your work exists.

The service depends on Google for sign-in and, for the CV import, on OpenAI. When one of those is unavailable, the part of the service that depends on it is unavailable too, and that is outside our control.

Suspension and termination

You may stop at any time. Ask us to delete your account and we will see the Privacy Policy for how, and how long it takes.

We may suspend or delete an account that breaks these terms, that is being used to harm somebody, or that we are required to act on by law. Where it is reasonable to do so we will say why first. A suspended account cannot sign in, and any session it already had stops working on its next request.

We may also close the service itself. If we do, we will give reasonable notice at the address on the account so that you can take your content with you.

Liability

To the extent the law allows, we are not liable for lost profits, lost opportunities, lost or corrupted content, or any indirect or consequential loss arising from your use of the service.

Nothing here excludes liability that cannot be excluded by law including for death or personal injury caused by negligence, for fraud, or for any right you have as a consumer that a contract cannot take away.

The service is currently provided free of charge. Where a limit on liability is capped by an amount paid, that amount is nil.

Changes to these terms

We may update these terms. The date at the top of this page always says when they last changed. If a change materially reduces your rights we will give notice at the address on your account before it takes effect; continuing to use the service after that is acceptance of the new version.

Governing law

These terms are governed by the law of Indonesia, and disputes go to the courts of Indonesia without affecting any right you have to bring a claim where you live, if the law where you live gives you one.

If any part of these terms turns out to be unenforceable, the rest stays in force.
